Terms of Use

These Terms of Use govern the relationship between Individual Entrepreneur Nikita Shchetko, tax number 322435995, address: Georgia, Adjara, Batumi (the “Service Operator”), and the individual using the SidusVita digital service located at www.sidusvita.com/ (the “User”), arising from use of the service.

By using the service, the User confirms that they have read these Terms, understand their content, and accept them in full.

1. Definitions

Service — the SidusVita digital service located at the website www.sidusvita.com/, providing users with access to platform functionality for performing astrological calculations, generating interpretations, storing user data, using artificial intelligence tools, and other features available in accordance with the access package chosen by the user and the current configuration of the Service.

Terms — these Terms of Use of the Service.

Package — the scope of Service functionality set by the Service Operator and available to the User in accordance with these Terms, including a specific set of features and usage limits.

2. Purpose of the Service

The Service is created solely for the purposes of entertainment, self-reflection, and self-discovery of Users.

The Service does not provide factual statements about the future, guarantees that any events or outcomes will occur, or professional opinions, and is not intended to be used as the sole basis for making legally or factually significant decisions. The Service does not replace consultation with a specialist on matters related to health, financial wellbeing, legal risks, etc.

You must not use the Service as the sole basis for decisions about health, mental wellbeing, safety, relationships, career, money, legal matters, or other significant life circumstances. You make any important decisions yourself and, where necessary, with a relevant specialist.

If you are in a crisis situation, feel at risk of harming yourself or others, or suspect a medical or psychiatric emergency, do not use the Service as emergency support and immediately contact the relevant emergency services or an in-person specialist.

3. Users

The User undertakes to provide accurate and up-to-date information necessary to use the Service.

3.1 Age Restrictions

The Service is intended for Users who have reached the age of majority under the laws of their country of residence / citizenship. Users who have not reached the age of majority under the laws of their country of residence / citizenship may use the Service only with the consent of, or under the supervision of, their parent or other legal representative.

By using the Service, the User confirms that:

  • they have reached the age of majority established by applicable law; or
  • they use the Service with the proper consent of their parent or other legal representative, where such consent is required by law.

If we become aware that a minor User is using the Service without the proper consent of their parent or other legal representative, where such consent is required by law, we may take reasonable measures to restrict or terminate access to the Service.

3.2 Incorrect Account Data and Unauthorized Use of Another’s Account

You are responsible for the accuracy of the data you enter during registration and in the User profile in the Service. If you sign in through third-party providers (for example, a Google account), you undertake to use only an account to which you have lawful access.

If we become aware that you are using the Service with incorrect data in your own account, or are unlawfully using another person’s account, we may take reasonable measures to restrict or terminate access to the Service.

4. Terms of Service Provision

The Service grants the User the right to access certain Service functionality to the extent provided by the purchased access Package, and the User purchases the relevant Package on the terms set by the Service Operator.

The Service offers Users several types of Packages with different sets of Base, Pro, and Voice requests. Each Package includes three types of requests that you can use to access one feature of the Service or another:

  • Base requests allow you to use the basic features of the Service (for example, a natal chart calculation, a follow-up question about it, etc.);
  • Pro requests allow you to use features that require deeper calculations (for example, an in-depth natal chart calculation, an in-depth follow-up question about it, etc.);
  • Voice requests allow you to use voice requests or a voice interpretation of a calculation (generating audio to listen to).

When you use certain Service features, the corresponding number of Base, Pro, and/or Voice requests is deducted from the User’s Package. Requests are deducted per single generation of a result of the relevant feature. Certain features may be available only in specific access Packages.

The current list of Service features, their usage limits, the composition of Packages, and the price and validity period of Packages are set out on the relevant pages of the Service and form part of the conditions for purchasing the relevant Package. The Service Operator may change all of these parameters together or separately in respect of Packages purchased after the relevant changes take effect. Such changes do not apply to Packages purchased before such changes take effect, unless otherwise provided by applicable law.

5. Payment, Provision of Digital Content, Right of Withdrawal, and Refunds

5.1 Payment and Provision of Access to the Service

The Service may provide free and paid access Packages. The current list of Packages, their price, feature composition, usage limits, and other conditions are published on the relevant pages of the Service and form part of these Terms. Each Package is a one-time purchase, is not a subscription, and does not renew automatically.

For free Packages, the service agreement is deemed concluded from the moment the User registers and accepts these Terms. The Service Operator’s obligations to provide access to a free Package begin to be performed from the moment the User is granted access to the functionality of that free Package.

For paid Packages, the service agreement is deemed concluded from the moment the relevant payment is successfully processed. The Service Operator’s obligations to provide access to the relevant paid Package begin to be performed from the moment the User is granted access to that Package.

Payment is made through the payment providers listed on the Service’s website. The User bears any costs charged by their bank, payment system, or payment instrument issuer (for example, currency conversion or international transfer fees), where such costs apply.

5.2 Right of Withdrawal from the Agreement

Because access to a paid Package begins immediately after the payment is successfully processed, by placing an order the User consents to the Service Operator beginning to perform its obligations under the service agreement before the withdrawal period expires, in cases where obtaining such consent is required by applicable law.

In the cases provided for by applicable law, the commencement of performance of the agreement before the withdrawal period expires results in the User losing the right to withdraw from the agreement after such performance has begun.

5.3 Refunds

Requests regarding refunds and disputed charges are handled through the Service’s support at: sidusvita.app@gmail.com. A refund request must include: the account email, the payment date, and a short description of the problem.

Decisions to issue a refund are made in the event of a technical failure (duplicate charge, obvious pricing error, incorrect provisioning of Service functionality in the Package to the User, etc.), as well as in the cases provided for by the terms of cooperation with the payment provider or by applicable law.

When reviewing a refund request, we may consider whether the Package was already successfully provisioned, whether its limits were used, whether there are reasonable indications of abuse, fraud, or circumvention of restrictions, and other factors related to the transaction.

We will aim to review your request as quickly as possible but, in any event, will send a response no later than 30 calendar days from the date of the request. Refunds are issued using the same payment method used for the original payment, unless otherwise agreed by the parties or provided for by the payment provider’s rules.

6. Rules of Use of the Service

When using the Service, it is prohibited to:

  • resell, transfer, or provide third parties with access to the Service without our written permission;
  • carry out mass collection (scraping), automated extraction, copying, or other extraction of the content and outputs of the Service;
  • reverse engineer, decompile, disassemble, or otherwise attempt to obtain the source code, algorithms, or internal logic of the Service, unless otherwise permitted by applicable law;
  • circumvent technical restrictions, usage limits, security mechanisms, or access controls;
  • use automated means (bots, scripts, programs, and similar tools) to interact with the Service in a way not provided for by its functionality;
  • falsify information about payments or access statuses, or commit other fraudulent acts;
  • upload, transmit, or distribute unlawful, harmful, defamatory, or abusive content, as well as content that infringes the rights of third parties;
  • use the Service in a way that may disrupt its operation, create excessive load on the infrastructure, or harm the Service, other users, or third parties;
  • use the Service in a way that violates applicable law.

We may impose technical restrictions on the frequency, volume, and methods of use of the Service without prior notice to Users.

In the event of a breach of these Terms, abuse of the Service, or where there are reasonable grounds to believe that the User’s actions pose a threat to the security or stability of the Service, the rights of other Users, or the requirements of applicable law, we may, without prior notice, restrict, suspend, or terminate the User’s access to the Service, and take other reasonable measures necessary to protect the Service and its users.

7. Intellectual Property

All rights to the Service, including its software code, design, interfaces, texts, graphic materials, databases, algorithms, trademarks, logos, and other intellectual property, belong to us or are used by us on lawful grounds.

Subject to compliance with these Terms, the User is granted a limited, non-exclusive, non-transferable, and non-sublicensable right to use the Service solely for personal, non-commercial purposes within the scope of its functionality. These Terms do not provide for the transfer to the User of any exclusive rights to the Service or its individual elements.

Without our prior written consent, it is prohibited to reproduce, distribute, publish, modify, or otherwise use the materials of the Service beyond its ordinary functional use.

8. Use of Artificial Intelligence (AI)

We may change the artificial intelligence models we use without prior notice to Users, provided that the overall functionality of the Service is maintained.

Some features of the Service use artificial intelligence technologies to automatically generate responses, interpretations, and recommendations. Such results are generated automatically, may contain inaccuracies, errors, or incomplete information, and must not be regarded as professional, medical, legal, financial, psychological, or other advice. The User independently assesses the information received and makes decisions at their own risk.

Although we use artificial intelligence in the operation of the Service, we do not make legally significant decisions solely by automated means. The use of artificial intelligence technologies does not mean that every result undergoes prior human review.

9. Third-Party Services

To operate certain features of the Service, we may use third-party services (including payment providers, authentication services, cloud infrastructure, and artificial intelligence technologies). The use of such services is carried out in accordance with these Terms, the Privacy Policy, and, where necessary, the terms of the relevant third parties.

10. Limitation of Liability and Force Majeure

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We do not guarantee continuous availability of the Service, the absence of errors, compatibility with all devices, or that results will meet the User’s expectations.

We are not liable for indirect losses, lost profits, data loss, or for the decisions and actions of the User taken on the basis of materials, calculations, or interpretations obtained using the Service.

We are not liable for the full or partial failure to perform, or improper performance of, our obligations under these Terms where such failure results from circumstances of force majeure beyond our reasonable control, including, among others, natural disasters, fires, floods, earthquakes, military actions, terrorist acts, civil unrest, epidemics and pandemics, strikes, decisions of public authorities, disruptions in communications networks, power supply, hosting providers and data centers, cloud infrastructure, payment systems, third-party services, and other similar circumstances.

Should such circumstances occur, performance of the relevant obligations may be suspended for the period during which they are in effect. We will make reasonable efforts to restore the operation of the Service as quickly as possible after such circumstances cease.

11. Confidentiality

The processing of Users’ personal data is carried out in accordance with our Privacy Policy, which is an integral part of these Terms. By using the Service, the User confirms that they have read the Privacy Policy.

12. Suspension or Termination of the Service

We may discontinue support, in whole or in part, for individual features, Packages, or the Service as a whole, by notifying Users within a reasonable time, unless otherwise required by law, security considerations, or technical necessity.

13. Notification of Users

Unless otherwise provided by applicable law, Users are deemed notified of changes to the Terms of Use, the Privacy Policy, and other legal documents by the posting of new versions of the relevant documents on the Service’s website. Users are also deemed notified of changes to the Service’s functionality through its update within the scope of access to the Service.

Where it is necessary to notify an individual user of something, for example the status of their support request, we will do so using the email address the User used when registering with the Service, or by another method agreed with the User.

14. Claims, Governing Law, and Dispute Resolution

If any questions or claims arise, we recommend that you first contact support at: sidusvita.app@gmail.com. We seek to resolve any issues through negotiation. We will aim to review your request as quickly as possible but, in any event, will send a response no later than 30 calendar days from the date of the request.

Contacting support does not limit the User’s right to apply to the competent public authorities or a court in the cases provided for by applicable law.

These Terms are governed by the laws of Georgia, unless otherwise provided by the mandatory rules of applicable consumer protection law.

The parties seek to resolve all disputes arising in connection with the use of the Service through negotiation. If no agreement can be reached, the dispute is subject to resolution by the competent court in accordance with applicable law. This provision does not limit the rights of consumers granted to them by the mandatory rules of the law of their country of habitual residence.

15. Changes to the Terms

We may change and update these Terms. A new version takes effect from the date of publication on this page, unless expressly stated otherwise. By continuing to use the Service after a new version takes effect, the User confirms their acceptance of the new version of the Terms.

If the changes materially affect the rights and obligations of Users, we will take reasonable measures to notify Users before the new version of the Terms takes effect.

16. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, this does not affect the validity of the remaining provisions, which continue in full force and effect.
